Terms and Conditions of Service

2. Purpose and scope of application

These Terms and Conditions (the "Terms") govern the access to, browsing of and use of the BYNDS online store (the "Site") and the purchase of the products offered through it (the "Products").

The use of the Site and the placing of orders imply full and unreserved acceptance of these Terms, as well as of the Privacy Policy, the Cookie Policy and the Returns Policy. If you do not agree with any of these terms, we kindly ask you not to use the Site.

3. Capacity to contract

To place orders through the Site, the user must:

• Be over 18 years of age and have sufficient legal capacity to enter into contracts.
• Provide truthful, accurate, complete and up-to-date information.
• Accept these Terms and the Privacy Policy.

BYNDS reserves the right to cancel orders where it detects irregularities, manifestly false data or reasonable suspicions of fraud.

4. Products and prices

4.1 Information about the Products

The Products offered on the Site are displayed with their description, image, size, composition, price and other relevant characteristics. BYNDS makes its best efforts to ensure that the images and descriptions are faithful to reality, although there may be slight variations in colour or texture arising from the calibration of your screen or from the natural properties of the materials.

4.2 Prices and VAT

All prices are shown in euros (€) and include the applicable VAT in accordance with the regulations in force. Shipping costs are calculated and displayed separately before confirming the order, in accordance with our Shipping Policy.

BYNDS reserves the right to modify prices at any time, although confirmed orders shall be governed by the prices in force at the time of purchase.

4.3 Availability

The Products are subject to stock availability. In the event that a Product cannot be supplied after confirming the order (due to stock running out or another cause of force majeure), BYNDS will inform the customer and will proceed to refund the full amount paid, without this giving rise to any right to compensation.

5. Purchase process

5.1 Placing the order

To place an order, the user must:

1. Select the desired Products and add them to the basket. 2. Access the basket and proceed to payment ("checkout"). 3. Identify themselves as a registered user or continue as a guest. 4. Provide the shipping and billing details. 5. Select the shipping and payment method. 6. Expressly accept these Terms and the Privacy Policy. 7. Confirm the order.

5.2 Order confirmation

Once payment has been completed, the customer will receive a confirmation email with the details of the order. This email constitutes the documentary proof of the contract. BYNDS will retain the electronic documentation of the contract and may provide it to the customer upon request.

5.3 Language of the contract

The contract may be formalised in Spanish or English, at the customer's choice.

6. Payment

6.1 Accepted payment methods

We accept the following payment methods:

• Credit or debit card: Visa, Mastercard, American Express (processed securely by Shopify Payments).
• PayPal.
• Apple Pay and Google Pay (where available on your device).
• Shop Pay.

6.2 Payment security

All transactions are carried out through PCI-DSS certified providers. BYNDS does not store the complete details of your card. The payment gateways used implement SSL/TLS encryption measures and strong authentication (3D Secure) in accordance with the PSD2 regulations.

6.3 Invoicing

BYNDS will issue an electronic invoice for each order. If the customer wishes to receive an invoice in the name of a company, they may indicate the CIF and company name in the corresponding field at checkout or request it afterwards at info@bynds-singular-creatures.com.

7. Shipping and delivery

The conditions, zones, timeframes and shipping rates are detailed in our Shipping Policy.

The transfer of risk over the Products will take place at the moment of delivery to the customer or to the person designated by them, in accordance with Article 66 ter of Royal Legislative Decree 1/2007.

If the customer does not collect the parcel within the timeframes stipulated by the courier company and it is returned to BYNDS, the costs of any second shipment will be borne by the customer.

8. Right of withdrawal and returns

The customer has the legal right of withdrawal of 14 calendar days from receipt of the Product, in accordance with Articles 102 to 108 of Royal Legislative Decree 1/2007, as well as our broader commercial policy of 30 days for returns.

9. Legal guarantee

In accordance with Royal Legislative Decree 1/2007 and Directive (EU) 2019/771, the Products come with a legal guarantee of conformity of 3 years from delivery. In the event of a lack of conformity, the customer has the right to repair, replacement, a reduction in the price or termination of the contract, under the conditions provided for by law.

To enforce the guarantee, please contact us at info@bynds-singular-creatures.com providing a description of the defect, photographs and the order number.

10. Intellectual and industrial property

All contents of the Site (texts, images, photographs, logos, the BYNDS brand, designs, graphics, source code and other elements) are the exclusive property of NAKED DESIGN STUDIO S.L. or of third parties who have authorised their use, and are protected by national and international intellectual and industrial property legislation.

The reproduction, distribution, public communication, transformation or any other commercial use of the contents of the Site without the prior, express and written authorisation of BYNDS is expressly prohibited.

11. Correct use of the Site

The user undertakes to use the Site in accordance with the law, these Terms, morality and public order. The following is prohibited:

• Placing false or fraudulent orders.
• Impersonating another person.
• Introducing viruses, malicious code or attempting to access restricted areas.
• Making unauthorised commercial use of the contents.
• Interfering with the proper functioning of the Site.

BYNDS reserves the right to deny access or cancel the accounts of users who breach these obligations.

12. Liability

BYNDS makes its best efforts to ensure that the Site functions correctly, but does not guarantee the absence of interruptions, errors or delays in access. BYNDS will not be liable for:

• Technical failures beyond its control.
• Damages arising from improper use of the Site by the user.
• Loss of data attributable to failures of the hosting provider (Shopify).
• Delays or breaches arising from force majeure.

In no event shall BYNDS's liability towards the customer exceed the amount paid for the order in question, except in cases where the law imposes greater liability.

13. Protection of personal data

The processing of the personal data provided by the user is governed by our Privacy Policy, which forms an integral part of these Terms.

14. Cookies

The use of cookies and similar technologies is governed by our Cookie Policy.

15. Modifications to the Terms

BYNDS reserves the right to modify these Terms at any time. The modifications will be published on the Site with the "Last updated" date. Orders placed before the modification will be governed by the version in force at the time of purchase.

16. Assignment

The user may not assign the rights and obligations arising from their contract with BYNDS without the prior written consent of BYNDS. BYNDS may indeed assign these rights and obligations in the event of corporate transactions, business transfers or other restructurings.

17. Partial invalidity

If any provision of these Terms is declared null or unenforceable by a competent court, the remaining provisions shall retain their full force and effect.

18. Dispute resolution and applicable law

18.1 Out-of-court claims

18.2 Online dispute resolution platform (ODR)

In accordance with Regulation (EU) 524/2013, we inform you that the European Commission makes available to consumers residing in the EU an online alternative dispute resolution platform accessible at:

18.3 Applicable law and jurisdiction

These Terms and the contractual relationships arising from them are governed by Spanish legislation.

For the resolution of any dispute, the parties submit to the Courts and Tribunals of the consumer's domicile, in accordance with Article 90.2 of Royal Legislative Decree 1/2007.
